1. Acceptance
By downloading, installing, or using the Maliban Street app, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
2. Eligibility
You must be at least 13 years old (or the minimum age in your country) to use the app. By using the app, you confirm you meet this requirement and can form a binding contract.
3. Account and security
You are responsible for keeping your account secure and for all activity under your account. You must provide accurate information. You may delete your account at any time via the in-app account deletion option.
4. Acceptable use and zero-tolerance policy
Maliban Street has zero tolerance for objectionable content or abusive behaviour.
You agree not to post, share, or engage in any content or conduct that is:
- Illegal, harmful, threatening, violent, hateful, abusive, harassing, bullying, or discriminatory
- Defamatory, misleading, or intended to intimidate or shame others
- Obscene, sexually explicit, pornographic, or otherwise offensive
- Encouraging self-harm, harm to others, or illegal activity
- Impersonating another person or misrepresenting your identity or affiliation
- Spam, scams, scraping, phishing, or use of bots or automated systems
- Infringing intellectual property, privacy, or other legal rights
- Interfering with the app, its services, servers, or other users
- Encouraging, promoting, or facilitating any of the above
Any user found engaging in objectionable content or abusive behaviour may have their content removed and their account suspended or permanently terminated without notice, at our sole discretion.
5. Your content
You keep ownership of content you post. By posting, you grant us a non-exclusive, royalty-free licence to use, store, display, and distribute that content in connection with operating and promoting the app. You are solely responsible for your content and confirm you have the right to post it. We do not endorse user content and are not liable for it.
6. Reporting, moderation, and blocking
You can report content and block other users within the app. Reports of objectionable or abusive content are reviewed in line with our policies.
We may take action including:
- Removing content
- Warning users
- Suspending or terminating accounts
We are not obliged to take any specific action in response to a report, but we reserve the right to act to protect users and the platform.
7. Child Safety Standards
Maliban Street is committed to protecting children and has zero tolerance for child sexual abuse and exploitation (CSAE) content or behaviour on our platform.
We strictly prohibit:
- Any content that sexually exploits or endangers children
- Sharing, soliciting, or distributing child sexual abuse material (CSAM)
- Grooming, sextortion, or any predatory behaviour toward minors
- Any attempt to contact minors for exploitative or inappropriate purposes
- Content that normalises or promotes the sexual exploitation of children
Any content or account found to be in violation of this policy will be immediately removed and permanently banned. We will report such content and behaviour to the relevant law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC) and equivalent agencies where applicable.
Users can report suspected CSAE content or behaviour through our in-app reporting tools or by contacting us directly at support@malibanstreet.com.
We regularly review and update our safety practices to ensure we meet the highest standards for child protection.
8. Intellectual property
The app (including design, branding, code, and non-user content) is owned by us or our licensors. You may not copy, modify, distribute, or exploit it without permission.
9. Disclaimers
The app and content are provided "as is." We do not guarantee uninterrupted or error-free service. We are not liable for user-generated content or third-party conduct. To the maximum extent permitted by law, we exclude implied warranties and limit our liability.
10. Limitation of liability
To the fullest extent permitted by law, we (and our affiliates, directors, employees) are not liable for indirect, incidental, special, or consequential damages, or loss of data or profits arising from your use of the app. Our total liability shall not exceed the amount you paid us in the 12 months before the claim (or NZD 10 if you paid nothing). Nothing in these terms excludes liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify us (and our affiliates, officers, employees) from claims, damages, losses, and costs arising from your use of the app, your content, or your breach of these terms.
12. Termination
We may suspend or terminate your access at any time for breach of these terms, including engaging in objectionable or abusive behaviour, or for operational or legal reasons. You may stop using the app and delete your account at any time. Sections that should survive termination will do so.
13. Governing law and disputes
These terms are governed by the laws of New Zealand. Any dispute will be resolved in the courts of that jurisdiction, without affecting your statutory rights under applicable consumer protection laws.
14. Changes
We may update these terms from time to time. We will post the updated version on our website and update the "Last updated" date. Continued use of the app means you accept the updated terms.
15. General
If any part of these terms is unenforceable, the rest remains in effect. Our failure to enforce a right does not waive it. You may not assign these terms; we may assign them to an affiliate or successor.
